Israel's Legal International Right's Ignored by BDSers

After King Solomon died in 920 BCE, Israel divided into Israel and Judah due to political differences.
King Saul ruled first, about 1,000 BC, then David,  followed by son Solomon.  Jordanians started
calling Judea and Samaria, the West Bank-west bank of the Jordan River.  
      What the BDS movement against Israel is doing is spreading lies about the legal rights that Israel has.  They are also hurting the very Palestinian Arabs that they think they are helping.  They are interferring with their rights to employment.  That's usually what meddlers do-mess up people's lives, not help them because they're poor at getting the facts.

"The Boycott, Divestment and Sanctions Movement (BDS Movement) is a global campaign attempting to increase economic and political pressure on Israel to comply with the stated goals of the movement: the end of Israel's occupation and colonization of Palestinian land and the Golan Heights, full equality for Arab-Palestinian citizens of Israel, and respect for the right of return of Palestinian refugees."  Arab Palestinans have had full equality since they became citizens.  They're in the Knesset and every other form of whatever citizens have.  The only difference for them is that they are not expected to enter the army.  Only those that have wanted to, like the Druze, do this.  The Arabs would like to flood the state with more Arab relatives connected to them, or not, but this is the one and only Jewish state.

The balance is not to be altered.  We now have a ratio of 6 million Jews to 1.7 million Arab citizens of Israel.   The "OTHERS" the Palestinians want to come in are descendants of those  who were in the land when Israel became a state on May 14, 1948 fled, told to leave as the Arab armies were coming to take over and it was after that that they could have Jewish homes, treasures, etc.  They had their chance and blew it.  They followed the wrong people, not the Jews who begged them to stay.  Golan Heights is not going back to Arab hands who had it before and rained all the rockets, mortars and missiles from there down onto Israelis.  NO WAY!  Jews also have a right to live where they are in Judea and Samaria.   ABC sections have already been discussed.  Now, how about talking about peace and not continuance of attacking Israelis?  First, stop the attacks so that people are in the mood to talk about their problems and solving them.  
                                                                               
The mandate of Palestine covered ALL the land of Palestine.  What you're looking at today
is mostly what has become Jordan.

WWI lasted from July 28, 1914 to November 11, 1918; 4 years, 3 months, 2 weeks long.  It took place in Europe, Africa, the Middle East, the Pacific Islands, China and off the coast of South and North America.                                                        

  The Ottoman Empire and Bulgaria joined the Central Powers against the Allies.  Palestine was a part of the Ottoman Empire.  Turkey lost their Ottoman Empire.  The Arabs are still in denial about it.  
The facts are that after WWI  in 1922,  representatives of the Jewish people were in conferences with the Allies.   The League of Nations Mandate for Palestine was given to the British.  The body of the League of Nations  Mandate recognized the Jewish National Rights in the WHOLE of the mandated territory of Palestine.

Recognition was given because the Jews had such a historical connections with Palestine and needed to claim their rightful place where they had been forced out and was to reconstitute their National Home in this land of Palestine again.  The members of the League of Nations did not create the rights of the Jewish People.  What they did was RECOGNIZE A PRE-EXISTING RIGHT.  This was the 2,000 year old quest of the Jewish people to re-establish their homeland.

By 1946, Israel's rights were preserved under the United Nations (UN) as well.  This is according to Article 80 of the UN CHARTER.  This established that nothing in the UN Charter should be construed to alter in any manner the rights whatsoever of any states or any  peoples or the terms of EXISTING INTERNATIONAL INSTRUMENTS.

These rights were unaffacted by the UN GENERAL ASSEMBLY RESOLUTION  181 of November 1947's Partition Plan, which was a NON-BINDING RECOMMENDATION  that was rejected by the Palestinians and the Arab states.   This is all documented.

JORDAN occupied the West Bank (Judea and Samaria-original Jewish land of the Israelites; king Saul, king David, King Solomon).  They had stolen the land by their illegal invasion in 1948 IN DEFIANCE of the UN SECURITY COUNCIL.  Then they had the temerity to annex the West Bank in 1950.  Remember, Abdullah was a prince from SAUDI ARABIA, not a native Palestinian, nor a Jew.  He was an outsider who had helped the Allies win WWI in the Middle East, same as the Jews did, only he had more men who fought.

Jordan's annexation of the WEST BANK was recognized by Pakistan and Great Britain but excluded the annexation of Jerusalem.  The ANNEXATION by Jordan was rejected by most of the international community, including THE ARAB STATES!  
                                                                           
Jordan insisted that the 1949 Armistice Line, the Israeli-Jordanian boundary until 1967, was not a recognized international border but ONLY A LINE SEPARATING ARMIES.  The Armistice Line Agreement specifically states:  NO PROVISION OF THIS AGREEMENT SHALL IN ANY WAY PREJUDICE THE RIGHTS, CLAIMS, AND POSITIONS OF EITHER PARTY HERETO IN THE PEACEFUL SETTLEMENT OF THE PALESTINE QUESTIONS, THE PROVISIONS OF THE AGREEMENT BEING DICTATED EXCLUSIVELY BY MILITARY CONSIDERATIONS.  (Article II.2)

NEVER was the word, "Occupation" used legally in other situations.  BUT ONLY IN THIS CASE, WITH THE WEST BANK AND GAZA, where no internationally recognized sovereign control previously existed, ISRAEL WAS LABELED WITH THE STIGMA AS AN "OCCUPIER."   There have been many other cases where international borders were crossed in armed conflicts and sovereign territory was seized; even in clear-cut cases of aggression.

EGYPT HAD BEEN OCCUPYING THE GAZA STRIP.  They also had invaded the land illegally in 1948, the time of Israel's announcement of their state which was the time of their fight, The War of Independence that was from November 29, 1947 to 1949 when the parties signed the Armistice Agreements.  This was a war started by the Arabs because they would not accept the UN partition resolution.  They came in from Syria, Lebanon and Egypt.   to reinforce local Arabs who were attacking Jews.
                                                                       
This was also a time that Jews held in Holocaust camps  were coming out of the Holocaust and needed a home.  They didn't want to return to Poland or Ukraine, places the native population had been helpers of the Nazis to kill them off.  They needed Israel and had been kept from there before even in 1940-41.Those that managed to arrive illegally themselves were thrust into fighting for their new country's life!

Where the prior holder of territory had seized that territory unlawfully, the state which subsequently takes that territory in the lawful exercise of SELF DEFENSE has, against that prior holder, better title.  So said Stephen Schwebel, former State Dept. Legal Advisor in 1970.  International jurists generally do draw a DISTINCTION between situations of "AGGRESSIVE CONQUEST"  after a war of "SELF DEFENSE".
The West Bank was to be part of the new Israel.  That was a deal.  It was stolen during an aggressive conquest.  Israel was fighting in self-defense.  Stephen Schwebel later headed the International Court of Justice in the Hague.

Israel only entered the West Bank AFTER repeated Jordanian artillery fire and ground movements across the previous armistice lines.  Jordan attacked at 10:00am.  Israel warned them to stop through contacts at the UN at 11:00am.  Jordan continued hitting Israel.  Israel's military action began at 12:45pm.  By then, Iraqi forces crossed Jordanian territory and were poised to enter the West Bank.  The temporary armistice boundaries of 1949 lost all validity the moment Jordanian forces revoked the armistice and attacked.     Israel took control of the West Bank as a result of a DEFENSIVE WAR.

Palestinians continue the fight by using the term, OCCUPATION, REPEATEDLY.  In this way they manage to reverse the causality of the conflict, and those judging it, the media, the governments, are too weak in their judgments to see the differences.  The people who use this term, Occupation or occupiers, are obfuscating this history.  The territorial disputes giving reasons to use BDS against Israel as one form of a weapon is not the result of a war imposed on Israel by a coalition of Arab states in 1967, rather more by the lies by the Palestinians.

It took place from August 15 to September 12, 2005.  Instead,
they've been shelled by the Arabs from there.

The results of the fighting is that Israel was only expected to withdraw FROM THE TERRITORIES to secure and recognized boundaries.   Israel was not expected to withdraw from THE territories or ALL the territories captured in the Six Day War of 1967.  You may say this is being picky-but it's a part of law. Lawyers have to recognize these important but teeny words and what they mean legally. (UN Security Council Resolution 242) The UN Security Council recognized that Israel was ENTITLED TO PART OF THESE  TERRITORIES FOR NEW DEFENSIBLE BORDERS.  242 MEANT THAT iSRAEL WILL NOT WITHDRAW FROM ALL THE TERRITORIES.  

With Resolution 338, it became clear that ONLY NEGOTIATIONS WOULD DETERMINE WHICH PART OF THESE TERRITORIES WOULD BECOME ISRAELI TERRITORIES AND TERRITORIES TO BE KEPT BY ISRAEL'S ARAB COUNTERPART.                                                                               
According the the UN's charter Article 80, nothing should be construed to alter in any manner the rights.
Israel has legal rights with respect to the West Bank and Gaza Strip that appear to be ignored by international observers who keep saying that Israel is an OCCUPIER.  Israel is not a foreign OCCUPIER with no territorial rights.  Israel has strong historical rights to the land that were already RECOGNIZED by the main bodies serving as the source of international legitimacy in the previous century.  

Judea and Samaria are divided by further talks into areas A, B, and C.  One is for the Palestinians, one for the Jews and one they both are in.  The Palestinians build illegally in the wrong places,  yet the international community stays blind to what they do illegally.  
                                                                        
BDS'ers Crusading against Israelis

We already know that Israel  pulled out of Gaza completely in the name of a promised peace which has given them nothing but a constant rain, a storm of rockets, mortars and missiles.  This is the opposite of a promised peace.  This is what Israel has experienced by listening to the Left.  Now they must protect themselves from a people who do not care at all to have their own state and live in peace with their neighbor, Israel.  BDSers are simply Old Crusaders  wanting to draw Jewish blood.

Khalizad is a former CIA operative, and undersecretary of defense in the George H.W. Bush administration who was a consultant for Unocal during the Clinton administration.

Talk about the American dream!   We've had a foreign born Ambassador go back and be ambassador to his home country, working under several presidents.

Zalmay Khalilzad (b: March 22, 1951)  has been our UN Envoy from the USA.  He's Afghanistan born and has been an American since 2004. "Zalmay Mamozy Khalilzad is a U.S. counselor at the Center for Strategic and International Studies and president of Khalilzad Associates, an international business consulting firm based in Washington, D.C He was the 26th USA Ambassador to the UN under George Bush from 2007 to 2009.  He's succeeded by Susan Rice.  Khalilzad was born in Mazar-i-Sharif but grew up in KabulAfghanistan, a much larger city.   He first spent time in the United States as a Ceres, California high school exchange student with AFS Intercultural Programs. Later, he attained his bachelor's and master's degrees from the American University of Beirut in Lebanon.   Khalilzad received his PhD at the University of Chicago in The United States.  He joined the State Department in 1984.  He's been the US Ambassador to Afghanistan and Iraq.  Khalilzad is a Sunni Muslim and belongs to the Pashtun ethnic group.   He is fluent in English, PashtoDari and  Arabic


What's his voting record in the UN as far as Israel goes?  He was considered pro-Israel in 2007   Jewish groups welcomed his appointment and said they hoped Khalilzad would continue strong US support for Israel in an arena often critical of the Jewish state. The UN is often critical of the Jewish state. Officials at the American Israel Public Affairs Committee said they "look forward to working with him." "Khalilzad is considered to have a positive attitude towards Israel and the US-Israel relationship," said Malcolm Hoenlein, vice chairman of the Conference of Presidents of Major American Jewish Organizations. "Based on his past record, we have every reason to anticipate that he will maintain the policies [in place] to date." Hoenlein added that Khalilzad's background could aid the US in the international body."

Before He Gained Power, Khalilzad said the  Israel Lobby “Paralyzed” Our Foreign Policy ." Evidently the Jewish groups missed this one in their vetting.                                                    

So wrote Philip Weiss in 2007.  In a 1997 paper for the Rand Corporation titled "The Implications of the Possible End of the Arab-Israeli Conflict for Gulf Security," Khalilzad (and 2 co-authors) described all the good things that would redound to the U.S. if we could only bring about peace between Israelis and Palestinians."  Yes, Israel always gets blamed because the Palestinians never want peace and have their own political agenda intermeshed with their religious reasons.  "Khalilzad attributed the special relationship with Israel to several factors:  "shared cultural bonds, U.S.-Israeli strategic ties [dwindling in the aftermath of the Cold War], and the well-organized pro-Israel sentiment in the United States:  The lobby." .  They are referring to AIPAC ( The American Israel Public Affairs Committee).  It works to strengthen   relations between the United States and Israel, not to tell Israel what to do.  It does this by bringing facts from Israel to the USA.  Evidently Khalilzad doesn't understand their position all that well.  
The USA " renewed criticism of the UN Human Rights Council in 2007, arguing it had shown a misplaced focus on Israel while giving a free pass to countries with poor human rights records. The US opposition failed.  The reason listed " was the "council's relentless focus during the year,  said US Ambassador Zalmay Khalilzad. "At the same time, the council failed during the year to address serious human rights.  This  year was spent on a single country - Israel,"  Violations were taking place in other countries such as Zimbabwe, DPRK (North Korea), Iran, Belarus and Cuba," he said. France supported the draft, as did Britain and China.

The UN Human Rights Council's draft resolution  on the body's working rules 145-7 through a rare vote forced by Israel was being opposed by Israel, United States and  five other countries, including Australia, Canada and the Pacific island nation of Palau. 
Durban I was held in South Africa in 2001.  However, also in 2007, Zalmay backed Durban  III, a strongly anti-Semitic world-wide meeting.  This happened after serving as ambassador to Iraq.  Had he picked up the negativity this enemy of Israel displayed?  The first Durban conference became an instrument for racism itself, particularly directed against Israel. This agenda was driven by Iran and a number of Arab states, and primarily by the participants in the antisemitic NGO (non-governmental organization) Forum.   The 2008 conference was just as bad.  "This Durban strategy, led by NGOs, is behind the BDS (boycotts, divestment and sanctions) efforts, which are justified using the rhetoric of human rights, to demonize and delegitimize Israel." On April 20-24, 2009, in Geneva, Switzerland, the United Nations will host the “Durban Review Conference,” (Durban 2) – a follow-up to the 2001 UN World Conference against Racism, Racial Discrimination, Xenophobia, and Related Intolerance (WCAR). As mandated by the UN General Assembly, the Human Rights Council of the United Nations (UNHRC) is responsible for organizing and convening the event “towards the effective and comprehensive implementation” of the conclusions and recommendations of WCAR, and to continue the “global drive for the total elimination of racism.”  Evidently it wasn't going well.  "Americans were asked to : Contact your congresspeople and senators. SECRETARY RICE AND AMBASSADOR KHALILZAD: America will not fund a racist conference under the Orwellian guise of its being "anti-racist."The Durban conferences had previously been criticized by Western governments for allegedly promoting rather than combating racism. AustraliaAustriaBulgariaCanada, the Czech RepublicFranceGermanyIsraelItaly, the NetherlandsNew ZealandPoland, the United Kingdom and the United States all boycotted Durban III held in NY City in November 2011.  The same countries, excluding Austria, Bulgaria, France and the United Kingdom, also previously boycotted the Durban Review Conference in 2009.
                                                                                   
He was interviewed on Fareed Zakaria's program, GPS this morning, which brought him to my attention.  Fareed asked him what he thought of Trump's anti-Islamic rhetoric?    Both men are Muslims.  
He's a Republican.   Would he want to work under Trump?  "According to the Washington Post, Khalilzad is “generally well liked by Democrats.”

Zalmay became a USA citizen while in Afghanistan along with 16 others on October 1, 2004.  He made a speech then, "Remarks by U.S. Ambassador and Special Presidential Envoy Zalmay Khalilzad at U.S. Citizenship and Naturalization Ceremony."  He also has citizenship with Austria, where he met his wife while serving as ambassador to Afghanistan.

George Bush appointed him. He was accused of backing Islamic fundamentalists who were attacking Afghanistan.   "Dr. Khalilzad? Would that be the same Zalmay Khalilzad who oversaw the mobilization, leadership, funding and coordination of, and the media support for, the Islamic fundamentalist terrorists who devastated Afghanistan and Bosnia?  Evidently his problems centered around oil.  "The  'oil consultant' label trivializes the harm Khalilzad has done."  "It was Khalilzad who drew up risk analysis for the trans-Afghan pipeline in the late 1990s.  The trans-Afghan pipeline was one of the primary agendas behind 9/11 and the invasion of Afghanistan.              
Taliban terrorists

Khalilzad negotiated for and with the Taliban. The Taliban are terrorists.  Khalilzad played a major role in the Bush administration’s Iraq strategy. Iraq is now  a failed state, mostly taken over by ISIS.  That strategy didn't work out well at all.

Moses' Awesome Dictum About Jewish LAND TO BE

The facts were recorded by Moses in what would become the Bible.  The frontiers were approximately on the West of the Mediterranean Sea;  on the East the Syrian Desert;  on the South the Brook of Egypt (Wadi El-Arish) to Kadesh Barnea, also to the Brook of Zin as far as the Valley of Zoar South of the Dead Sea, and in Transjordan from the river Arnon to Mt. Hermon, and to the Valley of Tyon..

I lived in Safed (Tzfat) in the Galilee (northern Israel) which is on top of a mountain,
about as high as Jerusalem is.  Syria is on the northern border. 

The total surface turns out to be 17,500 square miles of which about 45% is in TRANSJORDAN.  

The extent of the Promised Land reached the Pelusium arm of the Nile Delta, the Gulf of Elath, and the Euphrates River opposite Aleppo (Syria) in the East.  It included most of Syria and altogether covered about 58,000 square miles.                                                                              
The Jews keep returning to their Promised Land like salmon going upstream to spawn, or the swallows returning to Capistrano.  Why?  The place had been inhabited by someone so different since their absence, with obviously such different values that they want to kill Jews, so what's going on?  Evidently the rest of the world thinks that Israel has no business being there since they keep siding with the other people of the Middle East.  There never was a Palestine country, only a Palestine territory. It had become part of the Ottoman Empire who held it for 400 years up till WWI and was still, just a territory.

When the Israelites first entered with Joshua, the Canaanites, made up of little city-states, were very different from the Israelites.  After the battle, those who survived were assimilated into the Israelite society, most likely giving us some of the different DNA Y (male) haplogroups other than J1c3d.  (today's Cohen gene). For example, we have found E, G, I, J, R male haplogroup majority  in the Jewish population.  There were a few groups who were converted to Judaism, but it was rare.  Jews were a family of Jacob to start with, and have remained an endogamous society as well as a religion and culture.  They were warned by G-d through Moses not to assimilate into the Canaanite society because the moralistic value system of the Canaanites  was too different.  Their moral values would not continue if it happened.  The awesome thing is that Israel  has lasted for the past 3,000 plus years.  All the other ancient nations have died out except the Israelites who later were called the Jews since it was the state of Judah (southern part of the state of Israel) which had survived after the attack of Babylon in 597 BCE and again in 586 BCE.  
                                                                       
Moses was the founder of the Jewish religion, Prophet and Lawgiver,  that seems to be so contentious today to so many.  He was born in 1391 BCE to and died in 1271 BCE just before he could enter the Promised Land at age 120.  Joshua had to take over his position at that time.  He had been found in some sort of little basket on the water  by an Egyptian princess who was childless and raised by her, so was a Prince of Egypt, raised with all the royal education and position.  As it turns out, he finally found out that he had been the child of Israelite slaves, Amram and Jochabed.    Amram was the grandson of Levi, one of the tribes of Jacob, who originally came to Egypt 400 years previously with his 70 family members escaping a drought that had hit Canaan, their home.

  The Muslims say that Moses is a respected Prophet.  Are they following anything G-d-through Moses,  laid down for the Jews to follow?

The Israelites were not to stay in Egypt any longer.  Moses at age 80 was chosen as the leader to free them from this captivity that had lasted most likely about 300 years, since part of the 400 years were in living in Egypt over the time expected and frightening the Egyptians into thinking that the tribes had become too plentiful for the Egyptians"  own safety.  Egyptians were afraid that the Israelites would attack them because of their numbers.

when the angel of G-d appeared to Moses prior to his Divine call. The bush appeared to be on fire, but was not being consumed by it.  Moses was told that he was to be G-d's tool to lead the Israelites out of their suffering from Egypt. 
Moses had several wild experiences.  One was of hearing a voice-the voice of G-d and seeing that which was an angel of G-d.  One time he heard the voice speak out of a bush that looked like it was on fire but wasn't.  Finally the voice told him more about his new job, that of leading the Israelites back to where Jacob had come from.  He was told they were to take the land and gave Moses the geography-the size of the land it was to be.  Moses had not been there.  None of the Jews after 400 years had been there.  But now Moses thought he understood how to get there and how big it was to be.

This entire area was occupied by the Israelites under King David  (1010-970 BCE) and his son, King Solomon (961-920 BCE).  The facts are recorded in (I Kings 5:4).  The actual area under Jewish control fluctuated, and there were extensive gentile enclaves within Jewish territory.
                                                                             

Moses could not have known much about the land except what he learned through Egyptian education.  This was G-d telling him of the exact measurements that Moses passed onto the Israelites who 40 years later entered the land and had to fight to do so with Joshua  leading in about 600,000 former slaves who had been on the march for 40 years.
                                                                     
The Prophet Ezekiel-writing for the Jews in Babylon  in Ezekiel 46:13 writes of the boundaries for each of the 12 tribes as G-d stated:  2 portions for Joseph...each tribe equal to his brother...this land shall become yours as an inheritance. Ezekiel foresees the time when Israel to rise again and return to its home.  There, in Jerusalem, it will assume a new and eternal name-HASHEM (G-d) is there (48:35). The Jews returned in c516 BCE and again populated their tribe's land, joining the remaining descendants who were not stolen away.
 15. On the north side; From the Great Sea, by way of Hethlon, to the approach to Zedad, Harnath, Berothah, and Siraim which is between the border of Damascus and the border of Hamath, and Hazer-hatticon which is on the border of Hauran.  The border shall tus go from the Sea to haar-enon by the border of Damascus, with the northern border extending northward to the border of Hamath.  This is the northern side.
The eastern side:  Between Hauran and Damascus, between Gilead and the Land of Israel, the Jordan, you shall measure from the northern border to the Eastern Sea.
The southern side:  southward-from Tamar until the waters of Meriboth-kadesh, to the stream, to the Great Sea.
The western side: The Great Sea, from the southern border until opposite the approach to Hamath.

Today we have many people who do not believe in this power of creation we refer to as G-d.  They think that perhaps it was some aliens from outer space in a space ship broadcasting this to Moses.  If you have ever watched History 2 on TV, you have seen these theorists.  IF they are right, these aliens, as well as G-d, knew why this was to be.  Perhaps they, or G-d saw the future and had to see certain events come to be.  However you believe, this was something from a power higher than Moses, and Moses also gave us more than the geography of the Promised Land.  He gave us the rules of living in 10 Commandments and 613 other laws of ways to act under certain circumstances and what to do.  All these things came to Moses and he wrote them down.   They all are in the Bible.

The armistice agreements of 1949 left Israel with the broken promise of the U.N.  Instead of the land including Transjordan, they were given 8,000 square miles with complicated borders.

So why are people of the world demanding that Israel is always wrong about their living in a fraction of what is the Promised Land?  The circumstances of the past 3,000 years has been that Jews have been treated like Pariahs.  They have not been made welcome for any length of time in other lands.  Why didn't we pick Tasmania to return to live our lives?   We knew we had to live in one place.  G-d has ordained this.  It is our job to carry out this dictum.  This is a special time in the world.  It has been prophesied.

Today we see the USA still pushing for Israel to give more of it's 20% to Arabs who have denied them peace for the past 67 years.  Islam, as the Palestinians understand it, denies Jews living in their land again.  They will not make peace for their religious reasons. Muslims say Moses is a Prophet and a messenger.   "Moses is regarded by Muslims as teaching and practicing the religion of his predecessors and confirming the scriptures and prophets before him." If that is so, why does the Koran change things?

This is where they get their historical facts confused.  Moses's predecessor was Abraham who did teach the idea of one G-d only.  However, there were no prophets before Moses, lawgiver and first Prophet of the Jews who brought Judaism.   People of Canaan did not believe in one God.  They believed in many gods; a "polytheistic religion using idols, with families typically focusing worship on ancestral household gods and goddesses, the Elohim, while acknowledging the existence of other deities such as Baal and El, Asherah and Astarte." They cannot say that Moses was reflecting the religion of their Arab ancestors.  Canaanites and Abraham himself were familiar with human sacrifice.  That's not something Moses supported through G-d.  Abraham was about to sacrifice his only child but in the Jewish version, was stopped by G-d and that was to be the end of such practices.  The Muslim version is not found in the writings of Moses-found in the FIVE BOOKS OF MOSES of the Bible but in the Koran.  .
